The purpose of bankruptcy is to give you a true financial "Fresh Start." Depending upon your situation, you may qualify for either a "Chapter 7" bankruptcy or "Chapter 13" bankruptcy.
Chapter 7 Bankruptcy allows you to unburden yourself by quickly eliminating most outstanding debts. In a Chapter 7 bankruptcy, you will keep all of your exempt assets (in about 97% of the cases, all assets are protected in bankruptcy). The main advantage of Chapter 7 bankruptcy is speed.

Chapter 13 Bankruptcy consolidates certain debt (usually car loans and past-due payments on a car or home) and allows you to pay it off over 3-5 years. Although it is a longer-term commitment, the primary advantages of Chapter 13 are that you can (i) completely remove your second mortgage or HELOC on your house in certain situations; and/or (ii) have lower monthly out-of-pocket obligations by significantly reducing your car and/or home loan payments.
